NEW DELHI: The National Company Law Tribunal (NCLT) postponed the hearing of applications submitted by aircraft lessors on Friday until September 1. As a result, the revival of Go First is likely to experience further delays.
The Delhi High Court had previously refused Go First permission to fly lessors’ aircraft for planned maintenance, which led to the insolvency tribunal’s deferral.

Mahendra Khandelwal and Rahul P Bhatnagar, who make up a two-member NCLT bench, have ordered Go First’s resolution professional (RP) to provide details of the subsequent events within the next 10 days, including the condition of the leased aircraft’s upkeep.

The tribunal has also instructed the RP to submit a response to the arguments made by three new Go First lessors within the next two weeks, along with any rebuttal that they may have. Senior Advocate Ramji Srinivasan, speaking on behalf of the RP, informed the tribunal during the proceedings that Go First had petitioned the Supreme Court in opposition to the Delhi High Court’s rulings.

The Delhi High Court’s single-member bench had previously given Go First’s lessors access to and inspection rights over the aircraft they had leased to the airline. Go First then moved to the Supreme Court when the Division Bench of the High Court upheld this as well.

According to a prominent aviation industry expert, Go First’s chances of rebirth are getting more and more difficult as it continues to run into obstacles in courts and tribunals after ceasing operations on May 3.
