In the Elgar case, NIA rejects Shoma Sen’s request for bail

A two-judge panel consisting included Justice Augustine George Masih and Justice Aniruddha Bose expressed a preference to grant medical release for a brief duration.

NEW DELHI: The NIA angrily rejected Shoma Kanti Sen’s appeal on Thursday, arguing that she was ill in general and that her request for temporary bail in the Elgar Parishad case on health grounds was unexceptional.

On June 6, 2018, Sen, a professor of English literature and an advocate for women’s rights, was taken into custody. She has moved before the bench of the highest court for temporary bail on the grounds of declining health through her senior Supreme Court attorney, Anand Grover.

A two-judge panel consisting included Justice Augustine George Masih and Justice Aniruddha Bose expressed a preference to grant medical release for a brief duration. Justice Bose said, “We think we can give medical bail for a limited period of time.”

Senior law officer standing on behalf of the NIA, Additional Solicitor General (ASG) KM Nataraj, said the bench that Sen’s medical condition may be verified by a medical board and that nothing urgently needs to be treated. However, the Supreme Court did not issue any orders and rescheduled the case until December 6.
